Please read these Terms of Service (« Terms », « Terms of Service ») carefully before using the Read Tracker mobile application (the « Service », « Application ») operated by AGENCY STELLIA (« us », « we », or « our »).
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access or use the Service.
1. Description of Service
Read Tracker is a mobile application designed to help users track their reading progress, manage their personal book library, view reading statistics, and set reading reminders. The Application offers a free tier with limited functionality (e.g., a maximum of two books in the library) and a « Pro » version with full, unlimited features accessible via paid auto-renewable subscriptions managed through Adapty.io and the respective app stores (Apple App Store, Google Play Store).
2. User Accounts
(This section is relevant if you implement user accounts. If the app is currently 100% local without accounts, you can state that accounts are not required for the current version or remove this section and add it later.)
Currently, Read Tracker operates without requiring user account creation for its core local features. All book data, reading progress, and personal notes are stored locally on your device.
Subscription status is managed by Adapty.io and is associated with your App Store or Google Play account, and an anonymous Adapty Profile ID.
If future versions of the Application introduce user accounts for features such as cloud synchronization, you will be required to agree to updated terms related to account management, security, and data handling.
3. Subscriptions (Pro Access)
Certain features of the Service are billed on a subscription basis (« Subscription(s) »). You will be billed in advance on a recurring and periodic basis (weekly, monthly, or annually), depending on the subscription plan you select when purchasing a Subscription.
- Auto-Renewal: At the end of each billing cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or AGENCY STELLIA cancels it.
- Cancellation: You may cancel your Subscription renewal at any time through your App Store account settings (for iOS) or Google Play Store account settings (for Android). The cancellation will take effect at the end ofthe current billing cycle.
- Billing: A valid payment method is required to process the payment for your Subscription. Payments are processed by Apple (for App Store purchases) or Google (for Google Play Store purchases).
- Free Trial: We may, at our sole discretion, offer a Subscription with a free trial for a limited period. You may be required to enter your billing information to sign up for the free trial. If you do enter your billing information, you will not be charged until the free trial has expired. On the last day of the free trial period, unless you canceled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected. We reserve the right to modify or terminate the free trial offer at any time, without notice and in our sole discretion.
- Fee Changes: AGENCY STELLA, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current billing cycle. We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
- Refunds: Except when required by law, paid Subscription fees are non-refundable. Subscription cancellations are managed through your App Store or Google Play Store account. Please refer to Apple’s and Google’s respective refund policies.
4. Permitted Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
- To impersonate or attempt to impersonate AGENCY STELLIA, an employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm us or users of the Service or expose them to liability.
5. Intellectual Property
The Service and its original content (excluding User Content, as defined below), features, and functionality are and will remain the exclusive property of AGENCY STELLIA and its licensors. The Service is protected by copyright, trademark, and other laws of USA and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AGENCY STELLIA.
6. User Content
The information you input into the Application, such as book titles, authors, notes, reading progress, and session data (« User Content »), is stored locally on your device. You retain all ownership rights to your User Content. By using the Service, you grant us a limited license solely to store, process, and display your User Content on your device as necessary to provide the Service to you. We do not access, share, or use your User Content for any other purpose unless explicitly stated in our Privacy Policy or with your explicit consent for specific features (e.g., future cloud backup options).
7. Third-Party Services
The Application uses third-party services for specific functionalities:
- Adapty.io: For managing in-app subscriptions and paywalls. Your interaction with Adapty is subject to Adapty’s terms and privacy policy.
- Google Fonts: For dynamically loading typography. Use of Google Fonts is subject to Google’s terms and privacy policy.
- Book Search APIs (e.g., Google Books API): When you use the book search feature, your queries are sent to external APIs. Use of these APIs is subject to their respective terms and privacy policies.
We are not responsible for the practices of these third-party services.
8. Termination
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account (if account features are implemented), you may simply discontinue using the Service and uninstall the Application to remove locally stored data.
9. Limitation of Liability
In no event shall [AGENCY STELLIA, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii. any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
10. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an « AS IS » and « AS AVAILABLE » basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
[AGENCY STELLIA its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of France, California, USA, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
